Wife’s salary is more, husband approached the High Court, court’s decision- Husband cannot run away from responsibility

While giving an important verdict, the Punjab-Haryana High Court has made it clear that a husband cannot run away from his moral and familial responsibility towards his child by arguing that his wife earns more than him. The High Court has upheld the order of the Family Court of Moga, under which the father was asked to pay seven thousand rupees per month as maintenance allowance to his son.

While filing the petition, the father told the High Court that he is having a dispute with his wife. He has a daughter, who lives with his wife. He has filed a petition in the court for the custody of the daughter. It is pending. Meanwhile, his wife had filed a petition in the Family Court for the maintenance of the daughter. The Family Court of Moga had ordered that the petitioner will pay seven thousand rupees per month for the maintenance of the daughter.

The petitioner said that he does a private job and his salary is only 22 thousand rupees. With this salary, he has to maintain his entire family, while the petitioner’s wife does a government job and her salary is Rs 34500. The petitioner’s wife earns more than the petitioner and hence she can give a good upbringing to the daughter.

In such a situation, the order of the Family Court should be cancelled. The High Court said that children are the joint responsibility of both parents. It is the moral and familial duty of the father to provide for his children according to his lifestyle. He cannot escape from his responsibility by arguing that his wife earns more. With these comments, the High Court rejected the father’s appeal.
